Town granted intervention in Jones v Lizarraga election dispute


Tomorrow morning at 10:00 am, there will be a one hour hearing at the La Paz County Superior Court regarding Jennifer Jone's contest of the mayoral recall election in Quartzsite, AZ - Case No. CV201100117. Mayor-elect Jose' Lizarraga did not file a timely response, but the Town of Quartzsite filed a request to intervene, and Judge Burke granted the request, prepared by Town Attorney Martin Brannan. Jone's contest of the election maintains that Jose' Lizarraga is ineligible under town ordinance 2-1-10, and since incumbent Mayor Ed Foster had the second highest number of votes he is not recalled.

  1. I know you are busy since your case was heard today, but....GREAT JOB for standing up for the rule of law. There are great number of supporters that are just happy over the ruling. As one person stated on Supporters of Mayor Ed Foster Facebook page:
    "Lizarga is ineligible.
    Mayor foster is also ineligible , due to the arizona law which says that the position is declared vacant if the incumbant does not win the majority AND the winner (Lizarga) is found to be unqualified.
    A very good argument can be made that ...
    as the only qualified candidate left from the election..
    Jennifer Jones is now the legally elected mayor of Quartzsite."

    Just have to say that would be a head turner for all in the Council, not to say Mr Ed Foster...
